1. Agreement

These Terms of Service ("Terms") govern your use of this website and the vehicle sourcing and export services offered by First Coast Auto Export ("we", "us"). By using the site or our services you agree to these Terms. If you buy a vehicle, you will also sign a written sales agreement; if that agreement conflicts with these Terms, the sales agreement controls.

2. Our services

We help customers find, purchase, inspect and export vehicles from the United States to Lomé, Togo, and onward to neighboring countries on request. Services may include sourcing at auctions and dealers, inspection, towing, US port handling, ocean freight and export documentation. The exact services, price and vehicle for each purchase are set out in your quote and sales agreement.

3. Eligibility

You must be at least 18 years old and able to enter into a binding contract to use our services. You agree that the information you give us is accurate and complete.

4. Listings, quotes and availability

• Vehicles shown in our inventory are subject to prior sale and may be withdrawn at any time.
• Photos, descriptions, mileage and specifications are provided in good faith from our inspections and the seller's information, but may contain errors. The vehicle details confirmed in your sales agreement and inspection report control.
• Quotes are estimates based on information available at the time and are valid for the period stated. Auction prices, fuel surcharges, freight rates and exchange rates can change before a purchase is confirmed.
• Shipping times (typically 4–6 weeks) are estimates only and depend on vessel schedules, port conditions and customs.

5. Prices and payment

Unless your quote says otherwise, our price covers the vehicle, inspection, US towing, US port fees, ocean freight to Lomé and export documents. It does not include import duties, taxes, port charges, clearance or registration fees in Togo or any destination country, which are your responsibility.

We generally require a deposit before we buy a vehicle and full payment of the balance before it ships. The deposit amount, payment schedule, accepted payment methods and refund conditions are stated in your sales agreement. We never ask you to pay into a personal account; if you receive unusual payment instructions, contact us to confirm before paying.

6. Vehicle condition

Vehicles are used and sold "as is" unless your sales agreement expressly says otherwise. We inspect and photograph each vehicle before export and share the report with you, and we disclose salvage, rebuilt or other branded titles before you buy. Inspections cannot detect every defect, and to the fullest extent permitted by law we make no warranty of merchantability or fitness for a particular purpose.

7. Shipping, risk and customs

• You are responsible for making sure the vehicle can be legally imported and registered in the destination country, including age limits, emissions or other local rules.
• Ocean shipping involves risks outside our control, including weather, vessel delays, port congestion and customs inspections. We are not liable for delays caused by carriers, ports or authorities.
• Marine cargo insurance is available on request and is recommended. When and how risk of loss passes to you is set out in your sales agreement.
• You are responsible for collecting the vehicle and paying any storage or demurrage charges that arise after arrival notice if collection is delayed.

8. Cancellations and refunds

Because vehicles are often bought at auction on your behalf, purchases usually cannot be cancelled once we have committed to buy. Any refund of deposits or other payments is governed by your sales agreement. If we cannot source a vehicle matching your request, we will discuss alternatives or refund in accordance with that agreement.

9. Electronic signatures and records

You agree that documents may be provided and signed electronically, and that your electronic signature has the same legal effect as a handwritten one. We keep an audit record of each signing, as described in our privacy policy.

10. Tracking links

We may send you a private link to follow your vehicle. Tracking information is provided for convenience, may lag behind real events and depends on information from third parties. Keep your link private; anyone with the link can view your shipment status.

11. Acceptable use of the website

You agree not to misuse the site, including by submitting false requests, attempting to gain unauthorized access to our systems or other customers' information, scraping the site at scale, or interfering with its operation.

12. Intellectual property

The site and its content, including text, photos, logos and design, belong to First Coast Auto Export or its licensors. You may view and share pages for personal, non-commercial purposes, but may not copy or reuse our content commercially without permission.

13. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special or consequential damages, including lost profits or business, arising from your use of the site or our services. Our total liability for any claim relating to a vehicle purchase is limited to the amount you paid us for that vehicle and related services. Nothing in these Terms limits liability that cannot be limited by law.

14. Indemnity

You agree to compensate us for losses and costs resulting from information you provided that was false, or from your breach of these Terms or of import laws in your destination country.

15. Governing law and disputes

These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law rules. Before starting any formal proceeding, please contact us so we can try to resolve the issue informally. Unless your sales agreement provides otherwise, disputes will be resolved in the state or federal courts located in Duval County, Florida.

16. Changes to these Terms

We may update these Terms from time to time. The version in effect when you sign a sales agreement applies to that purchase. Continued use of the site after changes means you accept the updated Terms.
